These Terms and Conditions govern access to and use of the Plaza Yanahuara website (hereinafter, “the Site”). By accessing, browsing or using this Site, you acquire the status of User, and your use of the Site constitutes full and unreserved acceptance of these Terms and Conditions, which are mandatory and binding. If you do not agree with any of these conditions, you must refrain from using the Site or any of the services and content available on it.
All visits, operations and activities carried out on this Site, as well as their legal effects, are governed by these rules and are subject to the applicable legislation of the Republic of Peru. This includes, but is not limited to, Peruvian laws on copyright (Copyright Law, Legislative Decree No. 822) and industrial property (Industrial Property Law, Legislative Decree No. 823), among other complementary regulations. Plaza Yanahuara reserves the right to modify these Terms and Conditions at any time, without prior notice, by publishing the changes on this same Site. Therefore, it is the User’s responsibility to periodically review these terms to stay updated on any modifications; continued use of the Site after the posting of changes constitutes the User’s tacit acceptance of the new terms.
These Terms and Conditions will remain in effect until they are modified and a new version is published. This document was last updated on June 30, 2025.
2. Use of the Website
The User agrees to make proper and lawful use of the Site and its contents, in accordance with the purpose of Plaza Yanahuara and the provisions of these Terms. It is strictly prohibited to use the Site to carry out illegal and/or unauthorized activities, and/or activities that violate Peruvian laws, good customs, the rights of third parties or that in any way damage, disable or impair the Site or its web services. In particular, the User shall not attempt to breach the security or integrity measures of the Site through unauthorized intrusion activities (known as “hacking”) or other similar means.
Plaza Yanahuara Convention Center will not be responsible for delays, performance failures or interruptions in the operation of the Site that result from causes beyond its reasonable control (for example, technical problems in telecommunications, power outages, acts of third parties, etc.). The User also agrees to refrain from introducing or spreading computer viruses or any other harmful programs or components on the Site. Plaza Yanahuara does not guarantee the absence of possible malicious programs (viruses, malware, etc.) on the Site that are found on the internet network, beyond our administration and control. Therefore, the Site is exempt from liability for any damages or losses that may be caused to the User’s equipment or systems, and is released from all liability for such matters.
3. Intellectual Property Content
All content published on the Site (including, but not limited to, text, images, logos, graphics, designs, audiovisual material, databases, software and any other information) is the exclusive property of Plaza Yanahuara Convention Center or its licensors, and is protected by Peruvian and international intellectual property and copyright laws. This includes the rights of use, reproduction, distribution, public communication and transformation of said content. The User does not acquire any intellectual property rights or licenses over the contents of the Site simply by accessing or using them. The User is prohibited from reproducing, distributing, modifying, communicating to the public, transmitting, reusing, extracting, or in any way using the contents of the Site for purposes other than those expressly authorized in these Terms, without the prior written permission of Plaza Yanahuara Convention Center.
Personal and commercial use of the Site’s content is permitted provided that the reference to the source and corresponding ownership is retained, with the sole purpose of promoting the services offered at Plaza Yanahuara Convention Center. Any unauthorized commercial use of the content may result in legal action, including administrative, civil or criminal action as appropriate, to protect the rights of the Site.
4. Limitation of Liability
The Site strives to ensure that the information contained on the Site is correct, up-to-date, and complete; however, it does not guarantee the accuracy of such information at all times. The content and services are offered “as is”, without implied warranties. Plaza Yanahuara may make modifications or improvements to the information, services or content of the Site at any time, without prior notice.
Exemption from damages: To the maximum extent permitted by law, Plaza Yanahuara Convention Center will not assume responsibility for any damage or loss, direct or indirect, pecuniary or non-pecuniary damage suffered by the User or a third party as a result of the use of the Site, the information or content published on it, or the lack of availability or operation of the Site. This limitation includes, but is not limited to, damages due to errors or omissions in the content, transmission delays, performance failures, computer viruses, line failures, etc. Only if the damages are a consequence of a willful act or gross negligence on the part of Plaza Yanahuara Convention Center, could there be liability on our part, in accordance with applicable Peruvian legislation. In any other case, the User assumes the consequences of using the Site at their own risk.
Third-party links: The Site may contain hyperlinks or external links to third-party websites (e.g., from partners, sponsors, suppliers, or other entities). These links are provided solely for the User’s reference or convenience. Plaza Yanahuara Convention Center does not control or is responsible for the content, policies or privacy practices of these external sites, and their inclusion does not imply any approval or guarantee by Plaza Yanahuara Convention Center regarding them. Access to third-party pages through links on our Site is the sole responsibility of the User, who must abide by the terms and conditions of use of said external sites.
5. Privacy and Protection of Personal Data
Plaza Yanahuara se encuentra comprometida con la protección de la privacidad de los datos personales de los Usuarios. Any personal data provided by the User through the Site (for example, when completing contact forms, subscribing to newsletters, inquiries about events or services, etc.) will be processed in accordance with our Privacy Policy, described later in this document, and in accordance with current Peruvian legislation on the protection of personal data. By using this Site and providing your data, the User declares that they know and accept this Privacy Policy.
6. Applicable Law and Jurisdiction
All clauses contained in these Terms and Conditions shall be interpreted and enforced in accordance with the laws in force in the Republic of Peru. In the event of any dispute or claim arising from the use of the Site or the application of these Terms, and if it cannot be resolved amicably, the matter will be submitted to the jurisdiction of the competent courts of Peru, in accordance with current legislation.
